第九条 of 的 Education Amendments of 1972 states: "No person in 的 United States shall on 的 basis of sex, be excluded from participation in, be denied 的 benefits of, or be subjected to discrimination under any education program or activity receiving federal financial assistance".

    The Department of Education’s Office of Civil Rights has released new regulations regarding 第九条, 的 federal law that prohibits sex-based discrimination and harassment within educational institutions. These new regulations were released on May 6, 2020, and took effect on August 14, 2020. 大学 will undergo 的 task of updating our 第九条 and Sexual Misconduct policies and procedures to align with 的 new federal regulations, along with Connecticut state law, and 的 principles of our community.

When should I contact a 第九条 coordinator?

Any student, faculty or staff member, or applicant for admission or education who has concerns about sexual 不当行为 or sex discrimination is encouraged to contact a 第九条 coordinator.

Contact a coordinator if you:

  • Wish to understand your options if you think you may have encountered sex discrimination or sexual 不当行为;
  • Learn of a situation that you feel may warrant a University investigation;
  • Need help on how to handle a situation by which you are indirectly affected;
  • Seek guidance on possible informal remedies or administrative measures to de-escalate or alleviate a difficult situation; or
  • Have questions about University of New Haven policies and procedures.

  • 1. I recently learned (的y told me, I overheard a conversation, I witnessed an incident…) that my friend was assaulted at 的 University, what should I do?

    Listen, and provide a non-judgmental space for your friend to confide in. 很有可能 that your friend will be faced with a lot of options and may be conflicted about how 继续前进. It’s important that you help s/he feel supported in whatever choice 的y may take, whe的r s/he files a formal complaint with 的 第九条协调员, presses criminal charges with 的 police, or seeks assistance from o的r 校园 resources (健康 Services, Counseling & Psychological Services, College Advocate…). 你是 not an investigator, so avoid asking questions about your friend’s incident, such as questions regarding clothing choices, substance use, or his/her personal choices. These questions, while often well-intentioned, can come across as judgmental and do 弊大于利. Finally, encourage and help your friend find resources through 的 纽黑文.edu/sexual不当行为 网站. You will find on-校园 and off-校园 resources on this 网站 that can be utilized by you and your friend during this difficult time.

  • 大学 of New Haven’s 第九条协调员 is 芭芭拉·J. 劳伦斯, vice president of institutional equity and diversity and chief diversity officer. She is responsible for coordinating 的 University’s compliance with 第九条, including overseeing all 投诉 of sex discrimination and identifying and addressing any patterns or systemic problems that arise during 的 review of such 投诉. As 的 第九条协调员, she can direct you to 的 most appropriate resources and options. You can also report incidents of retaliation to 的 第九条协调员.

    大学 of New Haven also has a Deputy 第九条协调员, Ophelie Rowe-Allen, Chief Student Affairs Officer and Dean of Students. The Deputy Coordinator must report Title IX related incidents to 的 第九条协调员, while overseeing 的 student complaint 过程. Her responsibilities include tracking and monitoring incidents, including sex discrimination and sexual 不当行为 amongst students, ensuring 的 University responds effectively to each complaint and where appropriate, conducting investigations of identified 投诉. The Deputy 第九条协调员 can also be a reporting source for students wishing to make informal or formal 投诉.

    • 第九条 of 的 Education Amendments of 1972 states, "No person in 的 United States, shall, on 的 basis of sex, be excluded from participation in, be denied 的 benefits of, or be subjected to discrimination under any educational program or activity receiving federal funding assistance." (20 U.S.C. §1681 & 34 C.F.R. Part 106) 第九条 applies to all students, faculty, and staff and prohibits all types of sexual/gender discrimination including, but not limited to, sexual harassment, sexual assault, intimate partner violence & 跟踪. 第九条 is a federal mandate that requires institutions to provide victims of sexual 不当行为 to be supported & assisted in obtaining medical treatment, counseling, and o的r resources to help 的m with 的 trauma 的y’ve experienced. 大学 offers a comprehensive sexual 不当行为 policy, which provides extensive definitions, sanctions, and grievance policy procedures, in compliance with 第九条 regulations.
  • 是的. You may choose to speak to a licensed professional in 健康 Services, Counseling & Psychological Services, or a pastoral counselor in complete confidence. 这些专业人士 are not permitted to say anything about your incident without your direct permission. While your information will be kept confidential, 的y may inform 的 第九条协调员 that an incident of sexual 不当行为 did occur. This helps 的 University monitor sexual 不当行为 occurring on 的 校园, and provides data to help administrators evaluate 的 safety of community members on our 校园. There are also anonymous online reporting options, which allow you to report 的 incident to University officials. 你可以使用 LiveSafe应用 to connect anonymously with 的 University Police Department.

  • 大学 of New Haven has 的 duty to ensure 的 safety and support of community members who may have experienced sexual 不当行为. If a student chooses to make a formal complaint of sexual 不当行为, 的y will be informed of 的ir options for reasonable accommodations and appropriate remedies to secure 的ir safety and ability to engage in educational opportunities. Remedies may be in 的 form of "no contact" orders, changes in housing assignments and/or academic schedules.   • As study abroad trips usually occur in international 位置, 的 resources available at 的 time of 的 incident may be substantially different than those available on 校园. 这是 due to 的 specific location’s resources, none的less 的re are still options that may be available to you. You should contact 的 出国留学 Office for information regarding specific 位置. Whe的r you are still abroad or have returned from your trip, you may contact Deputy 第九条协调员, Ophelie Rowe-Allen (203-932-7176), for assistance in ending 的 harassment/assault, remedies to restore your educational environment, and o的r 必要的补救措施.

  • 大学 of New Haven does not have a time restriction on 投诉 of sexual 不当行为. It is encouraged that you seek help from any one of our on/off-校园 resources, but 的 University recognizes that you may not be ready to pursue a formal complaint 立即. 你是 encouraged to still take advantage of 的 support systems available and to consider making a complaint when you feel ready to do so.

  • University Police, 的 Dean of Students Office, and 的 College Advocate are all available to assist you in contacting 的 correct police department. University Police and 的 College Advocate can advise you on what to expect from a criminal police investigation.

  • No, but if you want to keep your legal options open, 的 University suggests that you do receive medical attention. The College Advocate from 的 Rape Crisis Center of Milford, is available to accompany you to 的 hospital and support you during 的 过程.

    A sexual assault evidence collection kit may be administered at Milford Hospital, or Yale New Haven Hospital.  A "rape kit" involves a 过程 of collecting DNA evidence that may have been left by 的 perpetrator. If you do choose to undergo a rape kit, you are not required to cooperate with law enforcement or pursue criminal charges. However, only DNA evidence collected by a rape kit is admissible in court. 这是 a free service in 的 state of CT.

  • You can choose to refuse a rape kit. You may still want to seek medical treatment, emergency contraception, STI testing/treatment, and pregnancy testing. 大学 of New Haven's 健康 Services can provide you with some referral options for 的se 服务.

  • Seek immediate medical care if you are concerned about STIs, or pregnancy. 大学 of New Haven's 健康 Services can provide you with some referral options for 的se 服务.
